Following the first webinar, this webinar considers the drafting of the trust deed and takes practitioners through critical elements that must be considered when drafting that include:

  • The trustees, their powers, duties and role;
  • Beneficiaries, discretionary and final;
  • Powers of appointment and removal;
  • The ways of transfer to assets (sale or gift, for example);
  • Other related documentation to have on your radar when drafting and setting up a trust such as the Sale and Purchase Agreement, Deed of Gift/Deed of Acknowledgement of Debt, e-dealing requirements and trustee resolutions;
  • Other critical elements pertinent to ensuring the longevity and flexibility of the Trust Deed.
