The move from an independent living unit at a retirement village into age-related resident care can be a challenging time for many residents. With 65% of retirement villages also offering some form of aged care, and approximately 5% of all retirement village units being care suites, aged care is often an important consideration for residents when they move into a village and as they transition to care. As legal advisors, our role is to help our clients understand the agreements that they are entering into, including their right to access care if they need it, and assist with the process of terminating their independent living occupation right agreements (ORAs) and using the termination proceeds to fund their aged care if that is required.

This webinar will discuss the legislative framework for retirement villages and aged care and then focus on practical aspects of the transition.

  • The retirement village and aged care legislative framework in New Zealand; and
  • The different levels of care and types of occupation.
  • The key terms of care suite ORAs and a summary of the differences between independent living ORAs and care suite ORAs.

  • Consideration of issues specific to care suites such as the costs of transferring, funding of aged care, and the different approaches for dealing with the 18% rebate.
