In Hoglie Trustee Limited as trustee of the Larry Robertson Family Trust the definition of “Final Beneficiaries” was linked the definition of “Discretionary Beneficiary” notwithstanding that Discretionary Beneficiaries were not otherwise referenced in the terms of the trust. The result of this was that the trust did not meet the requirements of section 15 of the Trusts Act 2019 due to the failure to properly identify the trust’s beneficiaries.

In this practical webinar, which will include a comprehensive paper and sample clauses, Vicki Ammundsen will guide her audience through the key clauses in trust deeds, what they mean, when variation is appropriate and how to ensure a cohesive trust deed that is fit for purpose.
